1. Acceptance of Terms

By accessing and using the Jute Polace website and purchasing our digital products, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, as well as our Privacy Policy and any other policies referenced herein. If you do not agree to these terms, you must not use our services or purchase our products.

2. Digital Products and Instant Delivery

Jute Polace Corp specializes in the sale of digital goods, including but not limited to:

• SVG cut files for Cricut, Silhouette, and other cutting machines
• Sublimation designs and print-ready graphics
• Embroidery patterns and templates in various formats
• Digital stickers, clipart, and decorative elements
• Craft project bundles and printable craft kits
• Mega design packs and comprehensive collections

All products are delivered electronically via instant download upon successful payment confirmation. No physical items will be shipped. You are responsible for ensuring you have the necessary software and equipment to access and use the digital files.

2.1 File Formats and Compatibility

Our digital products are provided in industry-standard formats including SVG, PNG, JPG, PDF, and embroidery machine formats such as PES, DST, and JEF. We make reasonable efforts to ensure compatibility with popular crafting software and machines, but we cannot guarantee compatibility with all devices or software versions. It is your responsibility to verify compatibility before purchase.

2.2 Download Access and Limitations

Upon purchase, you will receive immediate access to download your digital files. Download links are typically valid for 30 days from the date of purchase and may have a limited number of download attempts. We recommend downloading and backing up your files promptly. If you experience technical difficulties during download, please contact our support team within 7 days of purchase.

3. Pricing and Payment

All prices are listed in United States Dollars (USD) and are subject to change without notice. Current approximate pricing structure includes:

• Single cut files or individual designs: from $3.00
• Sublimation and print-ready designs: from $5.00
• Embroidery patterns: from $6.00
• Craft project bundles: from $19.00
• Mega design packs and comprehensive collections: from $35.00

We accept payment through major credit cards, debit cards, and other payment methods as displayed at checkout. All transactions are processed securely through our payment service providers. By providing payment information, you represent and warrant that you are authorized to use the payment method and authorize us to charge the total amount of your purchase.

3.1 Taxes

Prices do not include applicable sales tax, value-added tax (VAT), goods and services tax (GST), or other taxes that may be required by law. You are responsible for determining and paying any applicable taxes based on your location and tax status.

4. License and Usage Rights

Upon purchase and full payment, Jute Polace Corp grants you a non-exclusive, non-transferable, limited license to use the digital products for personal and limited commercial purposes, subject to the following conditions:

4.1 Personal Use

You may use our digital files to create unlimited physical items for personal use, gifts, and personal craft projects. Personal use includes items made for yourself, family members, and friends without monetary compensation.

4.2 Commercial Use - Small Business License

Unless otherwise specified, our standard license permits limited commercial use for small businesses and individual sellers. You may:

• Create and sell up to 500 physical items per design using our digital files
• Use our designs to create products for sale at craft fairs, markets, online marketplaces, and your own website
• Incorporate our designs into your handmade products and finished goods

4.3 Restrictions and Prohibited Uses

You expressly agree that you will NOT:

• Resell, redistribute, share, or transfer our digital files in their original or modified form
• Share download links or provide access to the files to any third party
• Claim our designs as your own original work or apply for trademark, copyright, or design patent protection
• Use our files to create designs or products for mass production or manufacturing (quantities exceeding 500 units per design)
• Include our digital files in any digital product, template, or design bundle for sale or free distribution
• Upload or make available our designs on print-on-demand platforms where the design file itself can be accessed by others
• Create NFTs (non-fungible tokens) or blockchain-based digital assets using our designs
• Use our designs in any way that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable

4.4 Extended Commercial License

If you require rights beyond our standard small business license, including mass production, manufacturing partnerships, or distribution to retail chains, please contact us at wholesale@jutepolace.com to inquire about extended commercial licensing options.

5. Intellectual Property Rights

All digital files, designs, graphics, text, images, logos, and other content provided by Jute Polace Corp are protected by United States and international copyright, trademark, and other intellectual property laws. Jute Polace Corp retains all ownership rights, title, and interest in and to the digital products and all intellectual property rights therein.

The purchase of a digital file grants you a license to use the file as specified in these Terms of Service, but does not transfer any ownership rights or intellectual property rights to you. All rights not expressly granted in these Terms are reserved by Jute Polace Corp.

6. Refund and Return Policy

Due to the nature of digital products and instant download delivery, all sales are final. We do not offer refunds or exchanges once a digital file has been successfully downloaded. By purchasing from Jute Polace, you acknowledge and accept this no-refund policy.

6.1 Exceptions

We may consider refund requests only in the following limited circumstances:

• You were charged for a product but did not receive access to the download link due to a technical error on our part
• The digital file is corrupted or damaged and cannot be opened, and we are unable to provide a working replacement file
• You accidentally purchased the same item multiple times in a single transaction

Refund requests must be submitted within 7 days of purchase and include a detailed explanation of the issue. Requests should be sent to support@jutepolace.com. We reserve the right to investigate all refund requests and make final determinations at our sole discretion.

6.2 No Refunds For

Refunds will NOT be issued for:

• Change of mind or buyer's remorse
• Accidental purchase of the wrong item (please review product descriptions carefully before purchasing)
• Inability to use the file due to lack of compatible software or equipment
• Dissatisfaction with the design, colors, or style after download
• Files that have been successfully downloaded and accessed

7. User Accounts and Security

You may be required to create an account to access certain features of our website and to manage your purchases. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other security breach. Jute Polace Corp will not be liable for any loss or damage arising from your failure to protect your account information.

8. Product Descriptions and Accuracy

We make reasonable efforts to ensure that product descriptions, images, and previews accurately represent the digital files you will receive. However, due to variations in computer monitors, software versions, and device settings, the appearance of colors, sizes, and other design elements may vary from what is displayed on our website. We do not guarantee that product descriptions or other content on our website are accurate, complete, reliable, current, or error-free.

9. Copyright Infringement and DMCA

Jute Polace Corp respects the intellectual property rights of others and expects our users to do the same. If you believe that any content on our website infringes your copyright, please contact us at info@jutepolace.com with the following information:

• Identification of the copyrighted work you claim has been infringed
• Identification of the material on our website that you claim is infringing

10. Limitation of Liability

To the maximum extent permitted by applicable law, Jute Polace Corp and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your access to, use of, or inability to access or use our website or digital products
• Any conduct or content of any third party on the website
• Any content obtained from the website
• Unauthorized access, use, or alteration of your transmissions or content

In no event shall our total liability to you for all damages, losses, and causes of action exceed the amount you paid to Jute Polace Corp for the specific product giving rise to the claim, or one hundred dollars ($100), whichever is less.

11. Indemnification

You agree to indemnify, defend, and hold harmless Jute Polace Corp and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Service or your use of our digital products in a manner that infringes the intellectual property rights of any third party.
